How fees, court and insurance calls work with us

The three worries we hear on almost every first call, answered plainly.

You pay nothing unless we recover money

We work on a contingency fee. There's no retainer and nothing to pay to get started. If we recover money for you, our fee comes out of that recovery at the percentage set in your written agreement.

If we don't recover anything, you owe us nothing, fees or costs.

Most injury claims settle without going to court

Calling us starts an insurance claim, not a lawsuit. Most injury claims are settled with the insurance company, without a trial.

If a lawsuit ever becomes the better route, we'll explain why first, and the decision is yours. Our firm keeps the case from start to finish instead of handing you to another firm once a suit is filed.

We handle the doctors, the bills and the adjusters

Once you hire us, the insurance companies call us, not you. We help you get seen by a doctor, keep track of every medical bill, and deal with the billing offices.

Your job is to get better.

Florida deadlines that can cost you your claim

Three rules most people don't hear about until it's too late.

2 years

to file most injury lawsuits in Florida

For negligence claims from incidents after March 24, 2023, Florida gives you two years to file suit (Florida Statutes section 95.11). That used to be four years, so many people still think they have more time than they do. Wrongful death claims also have two years.

Claims against a city, county or state agency have their own notice rules, and those can come due sooner. Building a strong claim takes time, so the earlier we start, the better.

14 days

to see a doctor after a car crash, or your PIP won't pay

Every Florida driver carries $10,000 in personal injury protection (PIP), but it only pays if your first medical treatment is within 14 days of the crash (section 627.736). Without an emergency medical condition, it stops at $2,500. Crashed in the last two weeks? Get seen today, then call us.

Over 50%

at fault means no recovery

Florida uses modified comparative negligence (section 768.81). If you're 50% or less at fault, your recovery is reduced by your share: 20% at fault on a $100,000 claim means $80,000. Over 50%, and you recover nothing. That's why adjusters ask early how the accident happened.

Call (888) 904-2524

Do I have to go to court?

Probably not. Most injury claims are settled with the insurance company, without a trial. Hiring us starts a claim, not a lawsuit. If filing suit ever becomes the better route, we'll explain why before anything is filed, and the decision is yours. Many cases that do get filed still settle before trial.

What does it cost to hire you?

Nothing upfront. We work on a contingency fee: our fee is a percentage of what we recover, set out in your written agreement. If we don't recover money for you, you owe us nothing, fees or costs. The case review is free.

What if I was partly at fault?

You can still recover in Florida as long as you were 50% or less at fault. Your recovery is reduced by your share of the fault. Insurance companies often try to push more of the blame onto you, so don't agree to their version of events before you talk to us.

What if I don't have health insurance?

After a car crash, your own PIP coverage pays 80% of reasonable medical bills up to its limit, whether or not you have health insurance, as long as you're treated within 14 days. For other injuries, or once PIP runs out, we'll help you find a doctor and explain how the bills get paid while your case is open.

How long does an injury case take?

It depends mostly on your recovery. A fair settlement waits until your doctors know the full extent of your injuries, because once you settle you can't go back for more. Simple claims can resolve in months; serious injuries take longer. We'll give you a realistic picture once we know your case.

What if the other driver didn't have insurance?

You still have options. Your own PIP covers the first part of your medical bills and lost income. If you carry uninsured motorist coverage, it can pay what the other driver should have. We'll check every policy that might apply, including ones you may not know about, like a household member's coverage.

Do I have to talk to the insurance adjuster?

You don't have to give the other driver's insurance company a recorded statement. Your own insurer can require some cooperation, and we handle that with you. Once you hire us, the adjusters call us, not you.

What is PIP, and why do the 14 days matter?

PIP is personal injury protection, the no-fault coverage every Florida driver must carry: at least $10,000 for medical bills and lost income, no matter who caused the crash. It only pays if you get your first medical treatment within 14 days. Miss that window and PIP can deny the claim entirely, so get checked even if you feel fine; some injuries show up days later.
