What changes the day you hire us

You have a damaged car, medical bills and an adjuster on the phone. Here's what comes off your plate.

We handle the insurance companies for you

Adjusters call fast after a crash, often before you've seen a doctor, and they ask for recorded statements. Once you hire us, we tell every insurance company involved that you have a lawyer. Their calls and letters come to us.

We help you get seen by a doctor, keep track of every medical bill, and deal with the billing offices. Your job is to get better.

You pay nothing unless we recover money

We work on a contingency fee. There's no retainer and nothing to pay to get started. If we recover money for you, our fee comes out of that recovery at the percentage set in your written agreement.

If we don't recover anything, you owe us nothing, fees or costs.

Most car accident claims settle without going to court

Calling us starts an insurance claim, not a lawsuit. Most car accident claims are settled with the insurance company, without a trial.

If a lawsuit ever becomes the better route, we'll explain why first, and the decision is yours.

How little you have to do after a crash

Here is the split of work once you hire us.

What you do

3 things

  1. Tell us what happened, by phone or with the form above.
  2. Go to your doctor appointments.
  3. Say yes or no to a settlement offer.

What we do

Everything else

  1. Tell every insurance company involved that you have a lawyer, so the adjusters deal with us.
  2. Help you get seen by a doctor inside your 14-day PIP window and open your PIP claim.
  3. Get the crash report, photos, witness statements and your medical records.
  4. Find every policy that can pay: the other driver's, your uninsured motorist coverage, a household member's.
  5. Track every medical bill and every missed paycheck.
  6. Work out what your claim is worth and negotiate with the insurer.
  7. Explain every offer to you in plain English, or in Spanish.
  8. File a lawsuit only if it's the better route, and only with your OK.

Florida car accident rules, in plain English

What the insurance companies know and most drivers don't.

80%

of your medical bills, paid by your own PIP

  • PIP pays 80% of reasonable medical bills and 60% of lost income, up to $10,000, no matter who caused the crash.
  • The full $10,000 is only available if a doctor finds an emergency medical condition. Otherwise PIP stops at $2,500.
  • Your first treatment has to be within 14 days of the crash.
  • Motorcycle riders aren't covered by PIP.

Florida Statutes section 627.736. Everything PIP doesn't cover is part of the claim against the driver who caused the crash.

2 years

to file a car accident lawsuit

For crashes after March 24, 2023, Florida gives you two years to file suit (section 95.11). Wrongful death claims also have two years. Building a strong claim takes time, so the earlier we start, the better.

Over 50%

at fault means no recovery

Florida uses modified comparative negligence (section 768.81). At 50% or less, your recovery is reduced by your share. Over 50%, you recover nothing. That's why adjusters ask early how the crash happened.

$0

of injury coverage required of Florida drivers

Florida requires $10,000 in PIP and $10,000 in property damage coverage. It does not require bodily injury coverage, so the driver who hit you may carry nothing that pays for your injuries.

UM

coverage can pay when the other driver can't

Uninsured motorist coverage is offered with every Florida auto policy and can only be turned down in writing. If you have it, it can pay what an uninsured or underinsured driver should have. We check every policy that might apply.

Car accident questions people ask before they call

Call (888) 904-2524

Do I have to go to court?

Probably not. Most car accident claims are settled with the insurance company, without a trial. Hiring us starts a claim, not a lawsuit. If filing suit ever becomes the better route, we'll explain why before anything is filed, and the decision is yours. Many cases that do get filed still settle before trial.

What does it cost to hire you?

Nothing upfront. We work on a contingency fee: our fee is a percentage of what we recover, set out in your written agreement. If we don't recover money for you, you owe us nothing, fees or costs. The case review is free.

What if I was partly at fault for the crash?

You can still recover in Florida as long as you were 50% or less at fault. Your recovery is reduced by your share: 20% at fault on a $100,000 claim means $80,000. Insurance companies often try to put more of the blame on you, so don't agree to their version of the crash before you talk to us.

What if I don't have health insurance?

You can still get treated. Your own PIP coverage pays 80% of reasonable medical bills up to its limit, whether or not you have health insurance, as long as your first treatment is within 14 days of the crash. Past that, we'll explain how the rest of the bills get paid while your case is open.

Who pays my medical bills while the case is open?

Usually in this order: your PIP first, then your health insurance or medical payments coverage if you have it. Bills those don't cover are paid from the settlement when the case resolves. We track every bill so nothing is missed when we negotiate.

What if the other driver had no insurance?

This happens a lot in Florida, because drivers aren't required to carry coverage for injuries they cause. You still have options. Your own PIP covers the first part of your medical bills and lost income. If you carry uninsured motorist coverage, it can pay what the other driver should have. We check every policy that might apply, including a household member's.

Do I have to talk to the insurance adjuster?

You don't have to give the other driver's insurance company a recorded statement. Your own insurer can require some cooperation, and we handle that with you. Once you hire us, the adjusters call us, not you.

I already talked to the adjuster. Is that a problem?

It's common, and it doesn't end your claim. Don't give another statement, don't sign anything, and don't accept a check that comes with a release until we've read it. A release can end your injury claim for good.

What is PIP, and why do the 14 days matter?

PIP is personal injury protection, the no-fault coverage every Florida driver must carry: at least $10,000 for medical bills and lost income, no matter who caused the crash. It only pays if you get your first medical treatment within 14 days. Miss that window and PIP can deny the claim entirely, so get checked even if you feel fine; some injuries show up days later.

Who pays for my car if it was totaled?

Your car is a separate claim from your injuries. The at-fault driver's property damage coverage (Florida requires at least $10,000) or your own collision coverage pays for the car, usually based on what it was worth right before the crash. Before you sign anything to settle the car, send it to us: some property damage releases are written broadly enough to cover your injury claim too.

Do you take cases outside South Florida?

Yes. We take car accident cases across Florida, with our main office in Coral Gables and offices in Miami, Orlando, Tampa, Naples, Pensacola and Panama City.
